Exemption: Self-Drive Rentals Are Not Public Transport

According to LTFRB regulations and guidelines from the LTO (Land Transportation Office), vehicles that are rented out without a driver (self-drive) for private use are not classified as public utility vehicles (PUVs).

Therefore:
Car rental companies offering private-use self-drive rentals do NOT need an LTFRB franchise.

This is because:

  • The vehicle is not transporting passengers for a fare
  • The customer operates the vehicle for personal/private use
  • There is no driver provided by the business

Requirements for Operating a Legal Self-Drive Rental

Even if an LTFRB franchise is not required, self-drive car rental operators must still:

  • Register the vehicle under “for hire” (private) or corporate use with the LTO
  • Maintain updated insurance (CTPL & optionally Comprehensive)
  • Use legal and signed rental contracts
  • Ensure clear terms of liability, use, and delivery conditions

What Happens If You Provide a Driver Without a Franchise?

Providing a driver for compensation without an LTFRB franchise is illegal. This can result in:

  • Vehicle impoundment
  • Fines up to ₱200,000
  • Criminal charges
  • Blacklisting from future LTFRB applications

To remain compliant:

  • Never market self-drive units as “for hire with driver”
  • Don’t accept payment for transport services unless legally franchised
